The ground rules for using Raphael: a Discord bot and website that keep the statistics of the nation roleplay server Edenwelt. Raphael is free, has no accounts and takes no payment, so these terms are short on purpose.
Read this before you use Raphael. It is written to be read. If any part of it is unclear, ask before you rely on it.
These terms are between you and the Operator: the single individual who develops and runs Raphael, who publishes under the handle Alicia. The Operator is not a company and these terms are not with one.
The Service means Raphael in its entirety: the Discord bot, the public website at raphaelnrp.duckdns.org, and the game-master console on that site. Where this document talks about you, it means the person using the Service.
By using the Service you accept these terms. If you do not accept them, do not use the Service.
Raphael is a simulation and record-keeping tool for a fictional nation roleplay. It holds a model of each nation, derives statistics from it, and shows those statistics back as a public dossier, a set of rankings, a catalogue of spirits and a technology tree. Time in Edenwelt advances in discrete steps, and Raphael recalculates the world at each step.
Raphael also provides a bot with commands for reading that data, and a console used by the game's game masters to edit it.
It is a game tool, and everything it shows is fiction. Nations, populations, economies, technologies and spirits in Edenwelt are invented for the roleplay. Do not treat a Raphael figure as a real-world fact, a real-world statistic, or advice of any kind.
You do not register for Raphael, and Raphael does not ask you to sign in. There is no password, no profile and no email address on file. The website is readable by anyone at its address.
Some game masters record a Discord user ID against a nation so that person can manage their own flag. That is a Discord identifier written into the game's own records by a game master; it is not a login and it does not grant you access to anything. How identifiers are handled is set out in the Privacy Policy.
Because there is no account, there is no password for you to leak and no recovery flow to abuse. Access to the game-master console requires a separate key that the Operator issues deliberately.
You agree not to:
Ordinary, reasonable use of the public website — reading it, linking to it, quoting a nation's dossier in conversation with attribution — is welcome and is not restricted by this section.
Some content on the Service originates with you or with other players: the written descriptions of nations — names, mottos, religions, leaders, allies — and the flag images attached to them. When you submit that content you keep ownership of it. By submitting it you grant the Operator a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display it as part of the Service, for as long as the Service operates.
That licence is what makes it possible for your nation to exist publicly. It ends when the Operator deletes the content, except to the extent it has already been incorporated into a public snapshot or ranking that remains on the site.
You confirm that you have the right to submit what you submit, that it does not infringe anyone else's rights, and that submitting it does not breach any confidentiality duty you owe. The Operator does not review content before it appears and cannot take responsibility for it. If you believe something on the Service infringes your rights, use the contact details in section 16.
Flag images are public. A flag uploaded for a nation is served from a predictable web address and can be viewed or fetched by anyone who has that address, including search engines. Do not upload an image that is private unless you are content for it to be public.
The Service is provided free of charge. The Operator does not sell access to it, sell SKUs through Discord, run subscriptions, or ask for donations in exchange for functionality. No part of the Service is paid, and no part of it requires a purchase to use.
This is a statement of the Service's current design, not a promise about the future. If a paid feature were ever introduced, it would be announced in advance, it would be optional, and it would not change the terms applying to the free parts of the Service without those terms being updated and published first.
The Operator may change, suspend or withdraw any part of the Service at any time, with or without notice. That includes commands, statistics, pages, game rules, and the host address of the website.
The website is served over HTTPS, but the Operator does not guarantee that it will be available, uninterrupted or error-free, and does not commit to any uptime, latency or performance target. Public DNS records used for the site are dynamic, so the address can change.
The Service is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.
Figures shown by the Service are computed from data that game masters enter. They may be wrong, may be entered wrongly, and may be corrected or recalculated at any time. In particular, no figure is a warranty, an assurance or a representation by the Operator.
To the fullest extent permitted by law, the Operator is not liable for any indirect or consequential loss, any loss of profit, revenue, data, goodwill or opportunity, or any loss arising from reliance on a figure produced by the Service.
To the fullest extent permitted by law, the Operator's total liability to you arising out of or connected with the Service, whatever the legal theory, is limited to zero: the Service is free, no fees are paid for it, and no loss of any kind is recoverable.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Where a limitation or exclusion is not permitted where you live, it applies to the greatest extent that is permitted there instead.
The Operator may edit or remove any content submitted to the Service, including a nation's written description or its flag, where in the Operator's sole judgement that is appropriate. The same applies to content that breaches section 4, that infringes a third party's rights, or that is not appropriate for a public audience.
Edenwelt is a roleplay run by its game masters. Decisions about what happens inside the game — whether a claim is accepted, which nation exists, how a dispute is settled — belong to them and not to the Operator. Raphael records those decisions; it does not make them.
You may stop using the Service at any time, for any reason or none. You do not need to tell the Operator and there is nothing to cancel, because there is no contract, no subscription and no payment.
The Operator may end your access to the Service, including by removing your association with a nation, if you breach these terms, or if the Operator is required to by Discord or by law.
Sections 8, 9, 10, 15 and 16 survive the end of this agreement, as does anything that by its nature should survive it.
Raphael runs on Discord. Discord is operated by Discord Inc. and is governed by Discord's Terms of Service and Privacy Policy, and its own Community Guidelines apply to the bot and to the Edenwelt server.
These terms govern Raphael only. They do not modify Discord's terms in any way, and using the Service on Discord means accepting Discord's terms as well. If there is a conflict between these terms and Discord's, Discord's terms govern the platform and these terms govern the Service.
Raphael stores your Discord user ID, the nation content you submit, and a limited record of commands used. What is collected, why, who it is shared with and how to get it deleted is set out in full in the Privacy Policy, which forms part of these terms. Read it.
The Operator may revise these terms. The revised version is published at raphaelnrp.duckdns.org/terms with a new effective date and version number, and that page is the only authoritative copy.
Material changes — anything that narrows your rights or expands yours — are announced in the Edenwelt server before they take effect. Continued use of the Service after the effective date means you accept the revised terms. If you do not accept them, stop using the Service.
These terms are governed by the laws of the jurisdiction in which the Operator is established, and the courts of that jurisdiction have exclusive jurisdiction over any dispute arising from them, without regard to conflict-of-law rules. Nothing here removes any mandatory right or mandatory consumer protection you have in the country where you live.
